1. Acceptance of Terms
By accessing or using Crualitics ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Platform. Crualitics is owned and operated by Sebastian Solo ("Owner").
2. Intellectual Property Rights
All Rights Reserved. The Platform and its entire contents, features, and functionality are owned by Sebastian Solo and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
3. Prohibited Activities
- No Copying: You may not copy, reproduce, duplicate, or create derivative works of the Platform.
- No Reverse Engineering: You may not reverse engineer, decompile, or attempt to derive the source code.
- No Scraping: You may not use automated tools, bots, scrapers, or crawlers to harvest data from the Platform.
- No Redistribution: You may not distribute, sublicense, lease, rent, or lend the Platform or any content.
- No Commercial Use: You may not use the Platform for commercial purposes without written authorization.
- No AI Training: You may not use Platform content or CRUAL's responses to train other AI systems.
- No Impersonation: You may not create competing services that mimic CRUAL Solo's personality or methods.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms.
5. Wellness & Safety Disclaimer
Important: Crualitics and CRUAL Solo are designed to provide supportive guidance and wellness tools but are NOT a substitute for professional mental health treatment. If you are experiencing a mental health crisis, please contact a licensed mental health professional or call emergency services immediately.
6. Subscription and Payments
All paid subscriptions are billed through Stripe, our secure third-party payment processor. Subscriptions auto-renew at the then-current price unless cancelled before the end of the current billing period. You may cancel at any time; cancellation stops future renewals, and your paid access continues through the end of the period you have already paid for. Partial billing periods are not refunded.
7. Privacy and Data Protection
Your privacy is important to us. Your data is encrypted in transit using HTTPS/TLS and protected at rest by our database and hosting provider's managed encryption controls. We do not sell or share your personal information with third parties for marketing purposes. CRUAL Solo maintains strict conversation confidentiality for all user conversations.
8. Limitation of Liability
To the fullest extent permitted by law, Sebastian Solo and Crualitics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Owner's jurisdiction.
10. SMS & Communications Policy
By providing your phone number during registration, you consent to receive SMS messages from Crualitics sent via Twilio. Message and data rates may apply. Message frequency varies.
Types of Messages We Send
- Account Security Codes: One-time passwords (OTPs) for password reset and identity verification. These are sent automatically as part of account security — they are not optional.
- Wellness Reminders (Optional): Daily check-in reminders, journaling nudges, and goal progress updates — only sent to users who opt in during registration.
- Crisis Support: Emergency resource messages if crisis-level content is detected in your wellness sessions.
Your Opt-Out Rights
- Reply STOP at any time to unsubscribe from all non-security SMS messages.
- Reply START to re-subscribe to optional wellness reminders.
- Reply HELP for help or contact us at CrualityLLC@gmail.com.
- Account security codes (password reset OTPs) cannot be opted out of — they are essential to account security.
SMS consent is not a condition of purchasing any goods or services. Your phone number is never sold or shared with third parties for marketing purposes. For questions about our SMS practices, contact CrualityLLC@gmail.com.
11. Data Retention & Account Deletion
If a subscription payment fails or a subscription is not renewed, the following lifecycle applies, measured from the date of the failed or missed payment:
- Grace period (Days 0–30): Your account stays active, with a daily reminder to update your payment.
- Frozen (Day 30): If payment is still unresolved, your account is frozen and access is paused until your balance is paid up to date.
- Archived (Day 60): If unpaid for 30 days after freezing, the account is removed from the live platform and moved to secure archive storage.
- Permanent deletion (Day 150): Archived accounts are kept for 90 days, after which all data is permanently and irreversibly deleted.
Returning users: If you resubscribe after deletion using the same email — or the same name, date of birth, and phone number — you will not receive another free trial and will be enrolled directly into a paid subscription.
Exemptions: Founding/grandfathered members, approved veterans within their benefit window, administrators, and designated lifetime accounts are exempt from this automated deletion process.
